Article 6. DELIVERY

Delivery of the goods will only be made after the payment of the full order amount has been accepted. In the event of any delay in delivery due to force majeure, as specified below in Article 12, the seller may choose to cancel the sale or extend the delivery or availability periods, without either of the parties being entitled to claim any compensation. In all cases, delivery within the established period will only be made if the customer has fulfilled all their obligations with ROS1 S.A..

Article 7. DELIVERY

The method of transportation selected by the seller is considered the most suitable for the delivery of their products. In the event that the customer disagrees in this respect, they must expressly request a different method. The acceptance of this request is at the seller’s discretion. Unless there is a specific stipulation to the contrary, the customer is liable for all transportation expenses.


The products delivered must be inspected within 72 hours from delivery. Without prejudice to any measures that may be adopted with respect to the transportation company, the customer must notify the seller by email of any apparent defect or non-conformity of the goods supplied, within the period specified for this purpose. After this period has elapsed, no claim of any kind will be admissible. If the customer expressly or implicitly waives the right to inspection before acceptance, it will be deemed that the goods have been delivered in accordance with the order. In the event of a defect or fault being identified after a subsequent re-inspection, the seller will only be under obligation to replace the goods acknowledged as faulty, at no expense to the seller, excluding any operating losses or additional damages. The customer has a period of 14 days from receipt of the product in which they may exercise their right to return the goods without having to justify their reasons or pay any penalties, with the exception of transportation expenses for the returned goods. The customer is liable for any expenses and risks involved in sending the returned goods. ROS1 S.A. will provide a refund for the returned product within 30 days from receipt of the returned package. The customer is liable for all expenses incurred from returning the goods derived from the right of the cancellation. No refund will be given in the case of any incomplete, damaged or dirty items. In such cases, they will be returned to the customer at the customer’s expense. In accordance with Article L 121-20-2 of the Consumer Code, the right to cancel stipulated for online sales cannot be exercised, unless the parties have agreed otherwise, in the case of contracts for the supply of goods manufactured to the consumer’s specifications or customized. The right of cancellation in the case of online shoppers does not apply to the sale of products that are customized at their request.
